1. Acceptance of Terms

Welcome to Tandem ("the Platform," "we," "our," or "us"). By accessing or using Tandem, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

These Terms constitute a legally binding agreement between you (the "User") and Tandem. If you are under 18 years of age, you must have parental or guardian consent to use this Platform.

2. Description of Service

Tandem is an AI-powered teaching and learning platform designed for students, teachers, and guardians. The Platform provides:

  • For Students: AI-generated quizzes, practice questions, personalized learning recommendations, gamification (XP, badges, streaks, challenges), reflection journals, and progress tracking
  • For Teachers: Quiz builder tools, AI question generation, question bank management, quiz scheduling, class analytics, and student progress monitoring
  • For Guardians: Weekly AI-generated progress digests, access to student achievements, and the ability to endorse reflections

3. User Accounts and Registration

3.1 Account Creation

To use Tandem, you must create an account by providing:

  • A valid email address
  • Your full name
  • A secure password
  • Your role (student, teacher, or guardian)

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your account information is accurate and up-to-date

3.3 Age Requirements

Students under the age of 13 must have explicit parental or guardian consent before creating an account. Students aged 13-17 should inform their parents or guardians of their use of the Platform.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use Tandem for:

  • Educational and learning purposes
  • Creating and managing educational content (teachers)
  • Monitoring student progress (teachers and guardians)
  • Personal skill development and practice

4.2 Prohibited Activities

You agree NOT to:

  • Use the Platform for any unlawful purpose or to violate any laws
  • Share your account credentials with others
  • Attempt to gain unauthorized access to other user accounts or the Platform's systems
  • Upload or transmit viruses, malware, or any harmful code
  • Harass, bully, or harm other users
  • Submit inappropriate, offensive, or harmful content
  • Scrape, copy, or extract data from the Platform using automated means
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use the Platform to cheat on assessments or academic work
  • Impersonate another user, teacher, or administrator

5. User Content and Intellectual Property

5.1 Your Content

You retain ownership of content you create on Tandem, including:

  • Reflection journal entries
  • Quiz questions created by teachers
  • Feedback submissions

By submitting content to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and process your content solely for the purpose of providing and improving the Platform's services.

5.2 Platform Intellectual Property

All intellectual property rights in the Tandem platform, including but not limited to software, source code, content, design, user interfaces, algorithms, and trademarks, are owned by Scott Anthony Clarke. You may not copy, modify, distribute, reverse engineer, or create derivative works without express written permission. Tandem is a trademark of Scott Anthony Clarke.

5.3 AI-Generated Content

Content generated by our AI features (quiz questions, recommendations, reflection prompts, feedback, guardian digests) is provided "as is" for educational purposes. While we strive for accuracy and quality, AI-generated content should be reviewed and used with appropriate educational oversight.

6. Educational Use and Academic Integrity

Tandem is designed to support learning and should be used as a supplementary educational tool. Users must:

  • Use the Platform ethically and in accordance with their school's academic integrity policies
  • Not use the Platform to circumvent assessments or plagiarize
  • Understand that AI-generated content is for learning support, not for submitting as original work
  • Follow their institution's guidelines regarding the use of educational technology

7. Privacy and Data Protection

Your use of Tandem is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

We comply with UK GDPR, the Data Protection Act 2018, and safeguarding regulations applicable to educational platforms.

8. Subscription and Payment Terms

Tandem may offer free and paid subscription tiers (if applicable):

  • Free Tier: Basic features available at no cost
  • Paid Subscriptions: Enhanced features may require payment (details provided at time of purchase)
  • Institutional Licenses: Schools may purchase licenses for multiple users

All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with advance notice to existing subscribers.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Service

Tandem is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Platform will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or completeness of AI-generated content

9.2 Limitation of Liability

To the fullest extent permitted by law, Tandem and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, profits, or academic performance
  • Service interruptions or technical failures
  • Reliance on AI-generated content
  • Unauthorized access to your account

Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid (if any) to use the Platform in the 12 months preceding the claim.

9.3 Educational Disclaimer

Tandem is an educational support tool and does not replace qualified teaching or professional educational assessment. Users should seek guidance from qualified educators for academic advice and decisions.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us at Tandem5.0@hotmail.com. Upon termination, your access to the Platform will cease, and your data will be handled according to our Privacy Policy.

10.2 Termination by Us

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Service
  • You engage in prohibited activities or misuse the Platform
  • Your account is inactive for an extended period
  • We are required to do so by law

We will provide reasonable notice before termination unless immediate action is required for security or legal reasons.

11. Changes to Terms

We may update these Terms from time to time to reflect changes in the Platform, legal requirements, or business practices. We will notify users of significant changes via email or platform notifications. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved through:

  • Mediation: If informal resolution fails, we encourage mediation before pursuing legal action
  • Jurisdiction: The courts of England and Wales shall have exclusive jurisdiction over any legal proceedings

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
